Untouchable soldier not untouchable

I had an Assault with Untouchable kill an alien, who then nevertheless got hit by an attack on the aliens' next turn (which was the only attack against him). I had another assault with Untouchable who also scored a kill on that same turn however, and that second soldier did so AFTER the one that actually got hit. Possibly Untouchable only works on the last soldier to qualify for it.

Vanilla behavior is that any ability that targets the unit will consume untouchable, even non-attacks like a captain mark. Did the soldier get marked before they were shot or targeted by some other ability?

Not that I could tell. That soldier killed the last officer on the map so it certainly wasn't that. The shot against the soldier was taken from high ground though.
